1. Acceptance of these terms

TawnyWatch (hereinafter referred to as "TawnyWatch," "we," "us," or "our") is a Shopify app built and operated by Digitaliiz, a partner of Shopify Inc. By installing or using the App, you ("you," the "merchant") agree to these Terms of Service (the "Terms"). If you do not agree, do not install or use the App.

2. The service

TawnyWatch provides Shopify merchants with SEO auditing, accessibility and compliance scanning, and session replay and behaviour analytics for their online stores, along with related support services (the "Services"). Features available to you depend on your selected plan, and we may add, change, or remove features over time.

4. Plans, billing, and cancellation

All billing is handled by Shopify. Subscription charges for paid plans are processed through Shopify's billing system in accordance with Shopify's terms, and appear on your regular Shopify invoice. We do not collect or store your payment card details.

You may cancel at any time by uninstalling the App or downgrading your plan from within Shopify. Cancellation stops future charges; any charges already billed by Shopify are governed by Shopify's billing and refund policies.

Because TawnyWatch can record store-visitor activity on your behalf, you are responsible for:

7. Data and privacy

Our handling of personal information is described in our Privacy Policy, which forms part of these Terms. You retain ownership of your store data; you grant us the limited rights needed to provide the Services to you.

8. Intellectual property

The App, including its software, design, and content, is owned by Digitaliiz and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable right to use the App while your account is active and in good standing. These Terms do not transfer any ownership rights to you.

9. Third-party services

The App relies on Shopify and other service providers to function. We are not responsible for the availability, terms, or practices of third-party services outside our control, and your use of them may be subject to their own terms.

10. Service availability

We aim to keep the App available and reliable, but we do not guarantee uninterrupted or error-free operation. We may suspend or limit the Services for maintenance, security, or operational reasons, and we may modify or discontinue features at any time.

11. Disclaimer of warranties

The App and Services are provided "as is" and "as available," without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. SEO, accessibility, and compliance results are informational and do not constitute legal advice or a guarantee of any outcome, ranking, or regulatory compliance.

12. Limitation of liability

To the maximum extent permitted by law, Digitaliiz and TawnyWatch will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising from your use of or inability to use the App. Our total liability for any claim relating to the App will not exceed the amount you paid for the App in the three months preceding the claim.

13. Termination

You may stop using the App at any time by uninstalling it. We may suspend or terminate your access if you breach these Terms or use the App in a way that risks harm to others, Shopify, or us. On termination, your right to use the App ends, and your data is handled as described in our Privacy Policy.

14. Changes to these terms

We may update these Terms from time to time. Material changes will be reflected by updating the effective date above, and your continued use of the App after changes take effect constitutes acceptance of the updated Terms.
